Legal basis: Our use of first-party analytics is supported by the first-party analytics provision introduced by the Data (Use and Access) Act 2025, which permits the use of cookies and similar technologies for the purpose of obtaining statistical information about the use of an information society service, provided the data is collected and processed by the service provider itself.

3.3 Advertising and Marketing Cookies

We use marketing technologies to measure the effectiveness of our advertising campaigns and to show relevant ads to users who have visited our platform. These cookies only load if you accept marketing cookies in our cookie banner.

4. What We Do Not Use

We believe in a privacy-first approach. We want to be clear about what we do not do:

  • No selling of cookie data: We never sell, rent, or trade data collected through cookies or similar technologies to any third party.
  • No device fingerprinting: We do not use browser or device fingerprinting techniques to track or identify you across websites.
  • Marketing cookies are off by default: Advertising and retargeting technologies such as the Meta Pixel only load if you actively accept marketing cookies. They do not run unless you opt in.

5. Managing Your Preferences

You have several options for managing cookies and tracking technologies:

  • Cookie banner: You can accept or reject analytics and marketing cookies at any time using our cookie banner. Marketing cookies (including the Meta Pixel) are denied by default and only load after you have actively opted in.
  • Browser controls: Most web browsers allow you to control cookies through their settings. You can set your browser to refuse cookies, delete cookies, or alert you when a cookie is being set. Please note that disabling strictly necessary cookies may prevent you from using certain features of the platform.
  • Opt out of PostHog analytics: You can opt out of PostHog analytics tracking by emailing us at privacy@makelemonade.io or by using privacy tools such as browser extensions that block analytics scripts.
  • Opt out of email tracking: You can disable image loading in your email client to prevent open tracking. Alternatively, you can contact us to opt out of marketing emails entirely, which will also stop associated tracking.

6. Data Retention

Data collected through cookies and tracking technologies is retained for the following periods:

  • PostHog product analytics: 24 months from the date of collection.
  • PostHog session replay data: 12 months from the date of recording.
  • Meta Pixel cookies: Up to 90 days on your device; event data held by Meta for up to 2 years in line with Meta's retention policies.
  • Email tracking data: For as long as your account remains active and as needed for service-related communications.

7. International Transfers

Some of the data collected through cookies and tracking technologies may be transferred to servers outside the United Kingdom:

  • PostHog: Data may be processed in EU and US data centres.
  • Meta Platforms: Data is processed in the United States and other countries where Meta operates.
  • Customer.io and Resend: Data is processed in the United States.

Where data is transferred internationally, appropriate safeguards are in place as described in Section 12 of our Privacy Policy, including Standard Contractual Clauses and the UK International Data Transfer Agreement.

8. Changes to This Policy

We may update this Cookie and Analytics Policy from time to time to reflect changes in the technologies we use, legal requirements, or our business practices. We shall provide at least 14 days' notice of any material changes by updating the effective date at the top of this page and, where appropriate, notifying you by email.
